38 Creative House GmbH (“38 Creative House”, “we”, “us”, “our”) is a creative agency based in Berlin, Germany. For all data-protection matters we are the “controller” within the meaning of the EU General Data Protection Regulation (GDPR).

2. What This Policy Covers
This policy explains in a general way what personal data we collect when you
• visit our website or social-media pages,
• contact us, or
• work with us on a project.
German websites must provide such information so that visitors understand “what data you collect, why you collect it, and who you collect it for” .
3. Data We May Collect
- Technical information such as IP address, browser type, pages visited and time-stamp, which is automatically sent by your device.
- Basic contact details (name, e-mail address, telephone number, company) that you choose to give us in a form, e-mail or phone call.
- Limited usage information from cookies or similar technologies (see section 6).
- Content you voluntarily supply in the context of a project or an application.
We do not intentionally collect sensitive (“special-category”) data.
4. How and Why We Use Your Data
We use personal data only to
• deliver and protect our website (legitimate interest),
• communicate with you and prepare or perform a contract (pre-contractual or contractual necessity),
• send you updates if you have explicitly asked for them (consent), or
• comply with basic legal record-keeping duties (legal obligation).
We do not profile you or make automated decisions that have legal or similarly significant effects.
5. Sharing of Data
We share data only where necessary for the purposes above. Typical recipients are our secure web-hosting provider, e-mail and cloud-service partners, and—if a project requires it—carefully selected freelancers under confidentiality agreement. Should data ever be processed outside the European Economic Area, we rely on standard contractual safeguards recognised by the European Commission. We do not sell your data.
6. Cookies & Similar Technologies
Our pages use cookies that are technically required to display the site. Non-essential cookies (for example, simple reach-measurement tools) are set only if you actively consent via the cookie banner. You can withdraw consent at any time through your browser settings.
7. How Long We Keep Your Data
We keep data only as long as it serves the purpose for which it was collected or is required by basic German retention rules (for example, tax documents must usually be stored for up to ten years). Afterwards the data is deleted or irreversibly anonymised.
8. Your Rights
Under the GDPR you have the right to
• ask for confirmation of whether we hold personal data about you,
• receive a copy of it,
• have inaccurate data corrected,
• request deletion or restriction of processing, and
• object to certain uses of your data or withdraw consent at any time.
You also have the right to lodge a complaint with your local data-protection authority. Our lead authority is the Berliner Beauftragte für Datenschutz und Informationsfreiheit.

9. Data Security
We use modern technical and organisational measures—such as HTTPS encryption, access controls and regular software updates—to protect your data against loss, misuse or unauthorised access. No internet transmission is ever completely secure, but we take reasonable steps to reduce the risks.
10. Changes to This Policy
We may revise this policy from time to time, for example to reflect changes in the law or in our services. The latest version is always available on our website and supersedes older versions.
